STANDARD TERMS AND CONDITIONS OF SALE


These Terms and Conditions govern the sale of courier and logistics services by Load Xpress (hereinafter referred to as “we,” “us,” “our,” or “Load Xpress”) to the client or customer (hereinafter referred to as “Client” or “Customer”). By using our services or making a booking, the Client agrees to the following terms:

1. Acceptance of Orders

All service requests and bookings are subject to acceptance by Load Xpress. We reserve the right to reject any request at our sole discretion.

2. Pricing

All service charges are quoted in Indian Rupees (INR) and are exclusive of applicable taxes, fuel surcharges, and statutory levies unless otherwise stated.

If we have provided you with a quotation, any changes to pricing will be communicated to you in advance via email, phone call, or WhatsApp message.

3. Payment Terms

  • All invoices must be paid on or before the due date as mentioned on each invoice.
  • A 5-day grace period will be provided after the due date. If payment is not received within this period, all courier services will be suspended until the payment is cleared in full.
  • A late payment interest of 15% per annum will be charged from the due date until the actual date of payment.
  • Payments can be made by:
    • Cheque in favour of “Load Xpress”
    • Online bank transfer (details provided in each invoice)

4. Discrepancies, Revisions, and Adjustments

  • Any request by the Client for changes, corrections, or disputes related to the invoice must be submitted within 7 days from the invoice date. No changes will be entertained after this period.
  • If any weight discrepancy or additional chargeable component (such as volumetric weight, re-attempt fee, or surcharge) is discovered after invoice generation, Load Xpress reserves the right to issue a Debit Note to reflect the revised or additional charges.
  • Such Debit Notes shall follow the same terms and payment conditions as the original invoice.
  • If the correction results in a reduction in the billed amount (e.g., if actual weight is lower than billed), a Credit Note will be issued, and the same terms apply.

5. Delivery and Risk

Load Xpress will use its best efforts to deliver shipments within estimated timeframes; however, we do not guarantee specific delivery times. We are not liable for delays caused by unforeseen circumstances or third-party handling.

6. Claims, Loss & Damage

  • Claims will only cover courier shipments that are officially marked as lost during transportation.
  • Damage to courier shipments will not be eligible for any claim.
  • All claims for lost shipments must be submitted within 7 days of the date we mark the shipment as lost.

7. Returns and Refunds

Once a courier service is rendered or dispatched, the fee is non-refundable. Refunds or credits, if any, will only be issued through Credit Notes, and are subject to approval based on valid reasons.

8. Force Majeure

Load Xpress shall not be liable for any failure or delay in service caused by circumstances beyond our reasonable control, including natural disasters, strikes, transport delays, or government restrictions.

9. Governing Law and Jurisdiction

These terms shall be governed by the laws of India. All legal disputes shall be subject to the exclusive jurisdiction of courts in Gurugram, Haryana.

10. Entire Agreement

These Terms and Conditions represent the entire agreement between Load Xpress and the Client and supersede any prior communications or agreements, unless expressly amended in writing and agreed upon by both parties.
